Industry prepares for impact of new 457 visa requirements

The restaurant and catering industry in Australia could see a return to the level of skill shortages that was seriously affecting the industry just two years ago as a result of new visa requirements for overseas workers, says the industry.

New laws to protect the rights of temporary overseas workers and ensure Australian wages and conditions are not undermined come into effect today.
A key provision in the new laws will enable the Australian Taxation Office (ATO) to disclose information to the Department of Immigration and Citizenship in order to ensure correct salary levels are being paid to visa holders.

From 14 September 2009, all sponsors of Subclass 457 visa holders (457 sponsors) will be required to adhere to new Sponsorship Obligations.

Five of our members at an abattoir at Narrikup – located out of Albany were allegedly made “redundant”. These members were very active within the Union leadership group and have been vocal about legitimate grievances about wages and conditions at Fletcher International.
Fletchers International have been sanctioned by the Department of Immigration and Citizenship for breaches of their obligations as sponsors of 457 visa workers. They have appealed to the Migration Review Tribunal – we do not know the outcome of that appeal yet.
DIAC processing puts visa applicants at risk

Commonwealth and Immigration Ombudsman Professor John McMillan today warned that Department of Immigration and Citizenship (DIAC) processing delays and inconsistencies in dealing with invalid visa applications could have serious consequences for the immigration status of applicants.
Between 1 July 2006 and 30 June 2008 DIAC assessed as invalid 16,547 visa applications, but the timeliness and adequacy of advice given to applicants about their invalid visa applications varied.

EMPLOYERS are facing difficult changes to their recruitment and employment plans after changes to work visas, which came into effect on July 1.
The changes included tougher English language requirements and with more changes to come including strict testing of skills for some 457 Visa workers, from countries the Australian Government has deemed high risk.
The slow down reported by DIAC in new visas being issued or applied is looking increasingly like it is not due to a slowing in demand, as there are still a lot of companies and industries in Australia that would like to use the 457 Visa.
